VIABILITY

Section 106 Negotiations & Agreement

Depending on the nature of the proposed development, Local Planning authorities often require land owners/developers to provide for infrastructure improvements to mitigate the harm of the proposed development and may require affordable housing to be provided on or off site.

Where such planning obligations are required by the Local Authority and are deemed to be unreasonable or likely to threaten the viability, and thus the delivery of the development, it may be necessary to negotiate with the Local Authority with a view to reducing the requirement for such obligations.
